Transboundary marine spatial planning in the Baltic Sea Region: towards a territorial governance approach?

This article examines whether the concept of territorial governance (TG) accurately captures the nature of governance and policymaking in transboundary marine spatial planning (TMSP) activities in the Baltic Sea Region. The focus of analysis is on the DG Mare–funded Baltic SCOPE and Pan Baltic Scope projects, which brought together key marine spatial planning stakeholders in the Baltic Sea Region to find solutions to TMSP issues. The five key dimensions of TG are examined against the transboundary collaborations undertaken during these two projects. The article finds that TMSP in the Baltic Sea Region shares many of the key characteristics of TG, such as, promoting learning and establishing stronger links between institutions, sectors and stakeholders; however, the TG concept fails to accurately capture the power dynamics at play in TMSP, particularly the central role of national planning authorities and certain sea use sectors in determining the overall direction of policy.

Unilateral Port State Jurisdiction: The Quest for Universality in the Prevention, Reduction and Control of Ship-Source Pollution

The capacity to act as a port state in international law is best described by the specific powers exercised over foreign ships, namely inspection, detention, expulsion or request of any type of information prior to the entry into the port. Many of these powers are explicitly attributed to the state in multilateral instruments, whereby the flag state consents to having its ships subject to the jurisdiction of the port state. Notwithstanding the consensus around the complementary nature of port state jurisdiction with respect to certain obligations of the flag state, the port state is not limited to fulfilling a secondary role. This is especially visible in the prevention, reduction and control of ship-source pollution, where some port states have not hesitated in acting regardless of an expressed consent by the flag state to the rule or standard being applied with the support of port powers. Not only do port states use more stringent enforcement powers to ensure that international treaties are effective, but they also prescribe novel rules and standards upon any foreign ship that approaches the port, often as a means of breaking an international negotiation deadlock. This study discusses the international legal basis for such unilateral jurisdiction by analyzing the principles of state jurisdiction under the dichotomy parochial/cosmopolitan. By interpreting the stated and implicit purposes of port state actions under that dichotomy, this study proposes that states are finding a legal ground to act based on certain legal functions they fulfill in the international legal order. This argument puts into perspective the assumed self-sufficiency of territoriality and shows how unilateralism may also serve to seek to set universally applicable norms.

Utility of collaborative GIS for maritime spatial planning: Design and evaluation of Baltic Explorer

Maritime spatial planning (MSP) needs tools to facilitate discussions and manage spatial data in collaborative workshops that involve actors with different types of backgrounds and expertise. Never the less, spatial tools in real-world MSP are only sparsely used. In the article it is argued that more knowledge about the use of GIS can support MSP is needed. It studies the use of GIS as a tool for collaborative MSP in five steps around development and testing of the prototype collaborative GIS, Baltic Explorer. The evaluation of the use found that the present functionalities of the system could support and facilitate the collaborative discussions in the MSP work. Still more research in the use of spatial data in the MSP process is needed.

Voluntary reporting in decarbonizing container shipping: The clean cargo case

Led by the UN’s International Maritime Organization (IMO) and the EU, the shipping industry struggles to reduce its greenhouse gas (GHG) emissions to align with the Paris Agreement. Clean Cargo, the leading voluntary buyer–supplier forum for sustainability in the cargo shipping industry, developed some years ago a methodology to calculate and report the GHG emissions from containerships. The recently introduced carbon emission requirements by the IMO and EU have reinforced the members’ interest in a new Clean Cargo reporting mechanism that enables a more effective and efficient monitoring of the decarbonization progress. A better understanding of the user needs accompanied by due consideration to the regulatory environment and the technological advances are key to build this new framework. This paper builds on the case of the Clean Cargo initiative to (1) identify the stakeholders’ expectations and motivations for voluntary disclosure of environmental information, and (2) discuss the governance challenges of voluntary initiatives. A questionnaire was designed and deployed to investigate the current uses of Clean Cargo data and the information sharing among different stakeholders. Voluntary schemes can speed up the decarbonization process by proposing standards accepted by all actors of the global value chain. Clean Cargo members envision reporting on absolute GHG emissions per shipment as the way forward.

Walking the managerial tightrope: top management involvement in product innovation projects

Design
Our data set, collected via surveys from top managers and project managers involved in 86 NPD projects in 85 firms, is analyzed using PLS structural equation modeling.

Purpose
This study examines how technical drivers as well as social drivers influence organic communication and top management involvement (TMI) in new product development (NPD) projects. Technical drivers are strategic importance and product innovativeness and social drivers are intrinsic and extrinsic relevance. Organic communication is defined as continuous, bi-directional, and informal communication between top management and the NPD teams. Further, arguing that TMI must be studied as multi-faceted construct, TMI is conceptualized to occur as guidance, active motivation, providing resources, and creating a tolerant climate. Subsequently, the effect of TMI and organic communication on NPD performance is investigated.

Findings
We show that the strategic importance of the project has a positive influence on TMI through active motivation, providing resources, and creating a tolerant climate for innovation, but does not have an effect on guidance. Results also show that active motivation and organic communication improve budget and schedule adherence, whereas providing guidance and stimulating a tolerant climate have detrimental effects. In summary, our results show that only active motivation enhances all types of performance while stimulating a tolerant climate appears to have the opposite effect. The results revealed that organic communication between top management and the NPD team has a strong positive effect on all elements of TMI (providing guidance, actively motivating the NPD team, providing resources, and creating a tolerant climate). In other words, when top management communicates with the NPD team throughout the project in an informal way and listens to the team in addition to engaging in a one-way communication, they are more likely to be seen by the team as being deeply involved in the project.

When ‘sustainability’ becomes the norm: Power dynamics in the making of a new eco-label for low-environmental-impact, small-scale fisheries

In 2020, the Danish Ministry of Environment and Food launched a new state-led ecolabelling scheme for fish originating from small-scale, 'low-environmental-impact' fisheries; "Nature-friendly". The label was introduced to a domestic market where the vast majority of the fish landed by Danish vessels was already certified by the global leader in certification of (wild caught) fish products, the Marine Stewardship Council (MSC). MSC's high market penetration created a situation where especially small-scale fishermen felt that MSC certification had developed into a market norm without providing fishermen the benefits of demonstrating extraordinarily sustainable practices and thereby gaining competitive advantages. Rather, MSC's market penetration was perceived as undermining efforts to brand and market fish originating from small-scale fisheries as particularly sustainable. This article explores the processes that led up to the NaturSkånsom labeling scheme by applying a 'power in planning and policy framework' as an analytical lens. Through the NaturSkånsom process, the article investigates what happens when an ecolabel becomes a market norm, how small-scale fisheries actors who feel disadvantaged by such a development and environmental organizations form alliances, mobilize support and multiple resources to strengthen their positions in the political settings. The examination of this case highlights how stakeholders traditionally thought of as less resourceful can gain political influence. The article offers a glimpse into a possible, emerging future where those who perceive themselves as the most sustainable producers may increasingly view large and dominating ecolabels simultaneously as obstacles and forces for positive change.

Who defines the need for fisheries reform? Participants, discourses and networks in the reform of the Greenland fishery

This article investigates recent reforms of the Greenland coastal fisheries in order to contribute to the general lessons on reform and policy networks in the context of a changing Arctic stakeholdership. It analyzes participation in fisheries governance decision-making by examining the emergence of discourses and policy networks that come to define the very need for reform. A policy network is identified across state ministries, powerful officials, banks and large scale industry that defined the need for fisheries reform within a 'grand reform' discourse. But inertia characterized the actual decision-making process as reform according to this 'grand reform' discourse was blocked by a combination of small-scale fishermen' informal networks and the power of the parliamentary majority. After a parliamentary shift in power the new government implemented the 'grand reform' gradually whilst new patterns of participation and exclusion emerged. In this process, the identities of the participating participants were reinterpreted to fit the new patterns of influence and participation. The article argues that fishery reform does not necessarily start with the collective recognition of a problem in marine resource use and a power-neutral process of institutional learning. Instead, it argues that fishery reform is likely to be the 'reform of somebody' and that this 'somebody' is itself a changing identity.
